(a) This section does not apply to US-41 or US-231, which are designated truck routes by the State of Indiana.

(b) All local streets and highways within the Town of St. John are designated as restricted streets. It shall be unlawful for the driver of any truck or vehicle with ten (10) tons or greater rated capacity to drive or park upon any restricted street within the Town when appropriate signs are erected along the routes.

(c) The restriction in this section shall not prohibit the operation of the following:

(1) Trucks upon any street where necessary to conduct business at a destination point, provided streets upon which such traffic is permitted are used until reaching the intersection nearest the destination point;

(2) Emergency vehicles upon any street in the Town;

(3) Trucks owned or operated by the Town, or any contractor, while engaged in the repair, maintenance, or construction of streets, street improvements, or street utilities within the Town;

(4) Trucks upon any officially established detour where such trucks could lawfully be operated upon the street for which the detour is established.

(d) For purposes of penalties, a "second-plus offense" shall apply to the second or subsequent offense (second, third, etc.) involving the same driver, the same vehicle, or the same company that owns or leases the violating vehicle in a calendar year and shall be a higher fine.
