(a) The Town may decide to use compensatory time in lieu of a monetary overtime. An explanation of how compensatory time works is as follows:

(1) Employees shall receive compensatory time off equal to one and one-half (1½) times hours physically worked in excess of forty (40) hours in a week.

(b) Nonexempt employees may take compensatory time off after a proper request has been submitted and approved by their supervisor.

(c) Compensatory time may be banked to a maximum of forty (40) hours. Supervisors are responsible for requiring employees to use banked time. Hours in excess of forty (40) may be granted at the discretion of the Town Manager.

(d) Upon termination of employment, the nonexempt employee is entitled to receive payment for accrued and unused compensatory time at the regular hourly wage rate in effect at the date of termination.
