(a) A police officer of the Town Police Department may conduct an inspection of a motor vehicle, semitrailer, or recreational vehicle for both residents and nonresidents of the Town. In the event a police officer of the Town conducts an inspection of motor vehicles, semitrailers, or recreational vehicles pursuant to the provisions of IC 9-17-2-1, et seq., as amended from time to time, that police officer shall specifically comply with the requirements and duties of an inspector under the applicable statutory provisions, as the same are amended from time to time. A police officer of the Town Police Department may be onduty or offduty for purposes of conducting the inspection contemplated by IC 9-17-2-1, et seq., as amended from time to time.

(b) In the event a police officer of the Town Police Department conducts an inspection of a motor vehicle, semitrailer, or recreational vehicle for a resident of the Town, there shall be no charge or fee for the conducting of such inspection. In the event that a police officer of the Town Police Department conducts an inspection of a motor vehicle, semitrailer, or recreational vehicle for a nonresident of the Town, then a fee of five dollars ($5.00) may be charged and collected for the conduct of such inspection. All fees charged and collected pursuant to the provisions of this section shall be deposited with the clerk-treasurer of the Town, and shall be deposited into a special vehicle inspection fund of the Police Department which is hereby established. All such fees charged and collected, and deposited into the special vehicle inspection fund of the Police Department may be used for law enforcement purposes only, and no other, in accordance with applicable state law and procedure.
