DIVISION 2. SERVICE CHARGES*

* Editor’s note: Ord. No. 0961, §§ 1, 2, adopted June 27, 1994, provided for a decrease and rebate for sewage treatment as follows:

1.That the decrease in the cost of treating sewage charged to the Town of St. John by the Town of Schererville be tracked and deducted from the rates and charges of the Town of St. John to its customers and a rebate provided to its customer base.

2.That, the decrease and rebate in the Town of St. John's schedule of rates and charges for sewage treatment shall be one dollar and eight cents ($1.08) per thousand gallons until the sum of one hundred thousand dollars ($100,000.00) more or less be rebated to its customer base and thereafter the treatment component of the sewer rate shall be one dollar and fourteen cents ($1.14) per thousand gallons.

Ord. No. 0944, §§ 1, 2, adopted September 28, provided for an increase in fees as follows:

1.That the increase in the cost of treating sewage charged to the Town of St. John by the Town of Schererville be tracked and added to the rates and charges of the Town of St. John to its customers.

2.That, the increase to the Town of St. John's schedule of rates and charges for sewage treatment shall be $0.34 per thousand gallons after October 15, 1995 and the treatment component of the sewer rate shall be $1.48 per thousand gallons.

Ord. No. 1063, §§ 1, 2, adopted November 25, 1997, provided for an increase in fees as follows:

1.That the increase in the cost of treating sewage by the Town of St. John Department of Sewer Works from the Town of Schererville be tracked and added to the rates and charges of the Town of St. John customers.

2.That, the increase to the Town of St. John's schedule of rates and charges for sewage treatment shall result in the establishment of a rate of $0.62 per thousand gallons.

Ord. No. 1304, §§ 1, 2, adopted Aug. 28, 2003, provided for an increase in fees as follows:

1.That the increase in the cost of treating sewage by the Town of St. John Department of Sewer Works from the Town of Schererville be tracked and added to the rates and charges of the Town of St. John customers.

2.That, the increase to the Town of St. John's schedule of rates and charges for sewage treatment shall result in the establishment of a rate of $0.92 per thousand gallons.

Ord. No. 1503, §§ 1, 2, adopted Dec. 30, 2009, provided for an increase in fees as follows:

1.That the Town of Schererville's increase in the cost of treating sewage and wastewater received from the St. John Sanitary District shall be tracked and added to the rates and charges for all customers and/or users of the St. John Sanitary District sewer system.

2.That the twelve-cent-increase in the Town of St John's schedule of rates and charges for sewer treatment shall result in the establishment of a rate of three dollars and nineteen cents ($3.19) per thousand gallons.

This section is included in your selections.

(a) Every person whose premises are served by the sewage works shall be charged for the services provided. These charges are established for each user class, as defined, in order that the sewage works shall recover, from each user and user class, revenue which is proportional to its use of the treatment works in terms of volume and load. User charges are levied to defray the cost of operation and maintenance (including replacement) of the treatment works. User charges shall be uniform in magnitude within a user class.

(b) User charges are subject to the rules and regulations adopted by the United States Environmental Protection Agency, published in the Federal Register September 27, 1978 (43 CFR 44022). Replacement costs, which are recovered through the system of user charges, shall be based upon the expected service life of the sewage works equipment.

(c) The various classes of users of the treatment works for the purposes of this article, shall be as follows:

(1) Residential;

(2) Commercial;

(3) Governmental;

(4) Institutional;

(5) Industrial.
