Ordinance No. 725

An Ordinance Adopting and Enacting a New Code for the Town of St. John, Indiana; Providing for the Repeal of Certain Ordinances Not Included Therein; Providing a Penalty for the Violation Thereof; Providing for the Manner of Amending Such Code; and Providing When Such Code and This Ordinance Shall Become Effective.

WHEREAS, the Board of Trustees of the Town of St. John, Lake County, Indiana, does now find that for purposes of simplicity and ease of utilization, it is necessary for the Town Code of the Town of St. John to be recodified and amended; and

WHEREAS, the Town of St. John, Board of Trustees, for said purposes, has employed the Municipal Code Corporation with offices at Tallahassee, Florida, to undertake said recodification.

NOW THEREFORE BE IT ORDAINED by the Board of Trustees of the Town of St. John, Lake County, Indiana, as follows:

Section 1. The Code entitled "Town Code, Town of St. John, Lake County, Indiana" published by the Municipal Code Corporation consisting of Chapters 1 through 23, each inclusive is hereby adopted.

Section 2. All ordinances of a general and permanent nature enacted on or before November 14, 1986, and not included in the Code or recognized and continued in force by reference therein are repealed, but for the subdivision and zoning ordinances and regulations.

Section 3. The repeal provided for in section 2 hereof shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance that is repealed by this ordinance.

Section 4. Wherever in the Code or in any ordinance of the town, or rule or regulation promulgated by an officer or agency thereof under the authority invested by law or ordinance, any act is prohibited or is made or declared to be unlawful or an offense, or the doing of any act is required, or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, the violation of any such provision of the Code, ordinance, rule or regulation shall be punished by a fine not to exceed two thousand five hundred dollars ($2,500.00). Every day any violation of this Code or any such ordinance, rule or regulation shall continue shall constitute a separate offense. The fine provided for in this section shall be the maximum fine which may be imposed in those cases where another provision provides for a minimum fine but does not provide for a maximum fine. Except as specifically provided otherwise, no town officer or employee shall be liable to fine for the failure to do any official act required by the provisions of this Code.

Section 5. Additions or amendments to the Code, when passed in the form as to indicate the intention of the town to make the same a part of the Code, shall be deemed to be incorporated by reference in the Code, so that reference to the Code includes the additions and amendments. Such additions and amendments must state that two (2) copies of the same are on file in the office of the Clerk-Treasurer for public inspection, and the copies must be on file as stated for such public inspection.

Section 6. Ordinances adopted after November 14, 1986, that amend or refer to ordinances that have been codified in the Code shall be construed as if they amend or refer to like provisions of the Code.

Section 7. This ordinance is a restatement and reenactment of the original St. John Town Code, and amendments thereto. Therefore, this ordinance is effective upon adoption and passage by the Board of Trustees of the Town of St. John, Lake County, Indiana this 11th day of January, 1988.
